IN A NUTSHELL

What is happening?

  • An Arizona woman, with mesothelioma cancer, was awarded $52.1 million by a California jury. The multimillion-dollar verdict includes damages from a forklift manufacturer and cosmetics company, Avon. Rita-Ann Chapman and her attorneys claimed that for the better part of her life, she used Avon talc products. As it turns out, these products were contaminated with asbestos. Chapman is 76 years old. She blamed her increased exposure to secondhand asbestos from forklift manufacturer, Hyster Company, since her Husband handled asbestos-containing materials while employed by Hyster.
  • Mesothelioma is an uncommon disease. The primary cause is typically exposure to asbestos fibers through eating or inhalation.

What allegedly went wrong?

Body and face powders were offered by Avon, a company noted for its door-to-door saleswomen known as “Avon Ladies.”

In California, jurors reached a verdict indicating that Avon was aware talc contamination, but hid the dangers it posed to consumers. of the jury awarded $40.8 million in actual damages and $11.3 million in punitive damages. At trial, it was revealed to the jury that  90% of Chapman’s cancer was attributed to the use of Avon products.

Avon was the target of about 200 talc lawsuits in 2021.  In 2020 Avon said it would stop using talc in its products, but continued claiming that their products are safe.
