What is Happening?

Instagram is suspected of violating an Illinois privacy statute by collecting users’ biometric information, including face scans, without first obtaining their written authorization. Instagram may have violated the Biometric Information Privacy Act (“BIPA”) by illegally using facial recognition software and improperly collecting personal data. What Allegation is Instagram Facing?

Instagram is accused of breaking the Biometric Information Privacy Act (“BIPA”), an Illinois-specific statute that offers safeguards for the gathering and storage of customer biometric data. Fingerprints, “voiceprints,” retinal or iris scans, and “faceprints”—scans of a person’s “facial geometry”—are all examples of biometric data.

Instagram users are not yet protected by Meta, Instagram’s parent company, which has previously agreed to pay over $550 million to settle charges that it violated BIPA by using its “tag suggestions” feature.

Why Does This Claim Only Apply to Illinois Residents?

The Biometric Privacy Act of Illinois prevents private sector companies and institutions, regardless of location, from collecting biometric data from unsuspecting residents in the state or online. BIPA goes on to prohibit data from being sold, transferred, or traded in any way when biometric data is gathered in contravention of the law. Illinois residents can sue for claimed violations.

If a company is found to have broken Illinois law, Illinois residents can seek civil penalties of up to $5,000 per violation.
