Baby Formula Toxicity Lawsuit

Published

on

The NEC Toxic Infant Formula Claims & Lawsuit allege that premature babies who drank toxic cow-milk based formula developed NEC (necrotizing enterocolitis), which is a serious and sometimes fatal illness that primarily affects babies who are born prematurely. NEC develops when otherwise healthy tissue in a baby’s colon becomes inflamed and damaged, often caused by bacterial infections.

Premature infants who are fed either Enfamil or Similac cow’s milk formulas are at a heightened risk for developing NEC. These types of formulas contain a bacteria that are thought to be one cause of NEC as well. People bringing lawsuits allege that manufacturers Abbot and Mead Johnson failed to warn the public of these dangers.

Symptoms of NEC include a swollen abdomen, diarrhea, bloody stool, green or yellow vomit, or lack of appetite and lack of weight gain. There is a 20% fatality rate for preterm infants diagnosed with NEC.

You may qualify to file a claim if your child was born premature and you used cow’s milk based infant formula and/or fortifiers and your baby developed the life threatening condition Necrotizing Enterocolitis.

Questions a LifeWallet attorney may ask in order to determine whether you have a claim:

  1. Was your child born premature?
  2. Was your child diagnosed with Necrotizing Enterocolitis (NEC)?
  3. Was your baby fed formula or fortifier while hospitalized?
  4. Year of birth of your child.

If you think that you qualify to file an NEC lawsuit, or want to find out more, please contact LifeWallet at 305-614-2222 as soon as possible, as there may be a statute of limitation on your potential claim.
